What is White Collar Crime?

White collar crimes typically occur in a business environment and often involve financial damage to a company or individual. Here is a list of just eight examples of white collar crimes commonly charged in Utah:

  • Bribery: Under Utah law, bribery includes both directly and indirectly giving any benefit to someone with the intent of influencing them in your favor.
  • Insurance Fraud: This type of fraud can involve giving misleading or false information to an insurance company, or not including relevant information on an insurance form.
  • Communications Fraud: This includes any scheme to obtain money from another person under false pretenses.
  • Forgery: You’re probably familiar with the concept of forgery as signing someone else’s name, or lying about a work of art or document to sell it for more than it’s worth. However, forgery crimes can also be more complex, like changing the wording of a legal document with the intent of defrauding a person or business.
  • Environmental Crimes: Environmental crimes include oil spills, unlawful disposal of hazardous materials, polluting water sources and improper use of pesticides or toxic chemicals.
  • Qui Tam Actions: This refers to employees helping with a lawsuit against their employer. If an employee suspects you of criminal activity, they can work with a prosecutor and potentially benefit from the lawsuit.
  • Tax Evasion: While refusing to pay a tax is an obvious crime, missing a deadline for paying a tax can also result in criminal charges.
  • Violation of Sarbanes Oxley Act: The Sarbanes Oxley Act includes strict rules and requirements about things like record keeping in order to protect investors.

Possible Penalties for White Collar Crimes

Aside from public knowledge of a criminal conviction following you for at least 10 years for a first offense, damaging your reputation and making it difficult to find employment, other punishments may include heavy fines or time in prison.

Severity of fines or length of jail time depend on things like how much money was involved, whether it’s a first, second, or third defense, and things you may not know about. Misdemeanors are the least harsh, with fines of around $1,000 and little to no jail time. First, second, and third-degree felonies result in larger fines and longer jail time.
