How Drug Free Zones Effect Drug Charges in Utah

Utah Drug Free Zone Drug Penalties

Utah Drug Free Zones

In metropolitan areas, including Ogden, SLC and Provo, it is hard to find non drug free zones. According to Utah's criminal code 58-37-8, a drug free zone is any area that is within 1,000 feet of any structure, facility, or grounds of any schools, child-care facilities, houses of worship, shopping malls, sports facilities stadiums, arenas, theaters, movie houses, playhouses, or parking lots or structures adjacent thereto. If you were in a drug free zone and are now facing drug possession, drug paraphernalia or drug distribution charges, the prosecutor can use an enhancement to the criminal code to greatly increase potential penalties. Is does not matter if you did not know that you were in a drug free zone. If the drug crime allegedly takes place in a drug free zone, the penalties can increase by at least double. Branson K.
