Utah police officers need probable cause of a traffic violation to initiate a traffic stop which can lead to a field sobriety test and a DUI arrest. Unfortunately, many officers misjudge or fabricate the probable cause for a traffic stop, claiming that a driver was swerving, never used a blinker, ran a stop sign, and so forth. The dash cam, however, can show that there was no probable cause for the stop and that the defendant did obey all traffic laws.
If you are facing Utah DUI charges, you should obtain a copy of the dash cam footage if it is available as it could make all the difference in winning your case. Most police departments in the state have a policy that they write over videos within a 30 day period. Therefore, if you want it, you MUST act quickly!
