Video Can Protect Your Rights

When you look back and see those lights flashing, you're scared. Your adrenaline begins to pump. And chances are, you won't remember most of your encounter with the police officer. You'll remember pieces. You'll remember how you felt. But you won't remember all of it. However, Utah law enforcement are trained to immediately write down a detailed account of what happened. If you go to trial several months later and you have to testify from memory, it will be extremely clear that the officer wrote their version down, while you are trying to pull details of your version from an already foggy memory. The jury will have no choice but to believe the officer, if for no other reason than they sound believable and you don't. This is where dash camera videos come in. Not all cops have them, but those that do can make a world of difference in your DUI case.

Fight Your Utah DUI With Video Evidence

Two cases have been resolved recently because of cameras. In one case, a man was accused of aggravated assault and the camera showed that my client's version was true. It was easy for the jury to acquit my client when presented with what really happened. In the other case, a DUI case, the officer claimed to have pulled my client over for a non-functioning license plate light. He also claimed that the tailgate from the truck blocked my client's plate. First of all, that doesn't even make sense. If the tailgate blocked the plate, how would he know if the license plate light was working? In any event, we got the video, and amazingly enough, the light was working and the tailgate did not block the plate. When we proved to the judge that the cop was lying, we got the case dismissed.

You need to know that there are details of your case that may only be accessible through video. Most police departments in the state have a policy that they write over videos within a 30 day period. Therefore, if you want it, you MUST act quickly! It can make all the difference in your case.
